TERMS OF SERVICE

Welcome to Piece Of Cake Events.
These Terms of Service apply to bookings, quotations, purchases, event planning, coordination, styling, creative direction, hire, balloon décor, custom products, supplier sourcing and management, entertainment arrangements, event production, delivery, installation, collection and other products or services supplied or arranged by Piece Of Cake Events (“we”, “our” or “us”).
These Terms apply to private, corporate, school, community, club, government and other events unless otherwise agreed in writing.
By accepting a quotation, placing an order, paying a booking retainer, deposit or invoice, confirming a booking, collecting hire items, accepting delivery or otherwise engaging our services, you agree to these Terms together with any quotation, invoice, product-specific conditions and applicable policies provided to you.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
1. OUR SERVICES
Piece Of Cake Events provides and/or arranges a broad range of event-related products and services, which may include:
Event planning; event coordination; on-the-day coordination; event styling; creative direction; event design and concept development; corporate events and activations; community events; school and club events; weddings and private celebrations; furniture and prop hire; backdrops and signage; balloon décor and installations; floral and decorative elements; event equipment hire; entertainment sourcing and coordination; musicians, DJs and performers; catering and food-truck sourcing; coffee carts and mobile vendors; photography and videography; security services; event nanny and childcare arrangements; venue sourcing and liaison; AV, sound and lighting; specialist contractors; delivery, installation and pack-down; helium tank hire; machine hire; DIY hire and collection; custom and personalised products; and other suppliers, products and services required for an event.
The exact products and services included in your booking will be those specified in your accepted quotation, invoice, online order or other written booking confirmation.
2. QUOTATIONS
2.1 Quotations are generally valid for thirty (30) days unless otherwise stated.
2.2 A quotation does not reserve an event date, staff member, supplier, product or hire item until the booking requirements specified by Piece Of Cake Events have been completed.
2.3 All products, suppliers and services remain subject to availability until the booking is confirmed.
2.4 Prices may change after a quotation expires.
2.5 We may correct genuine pricing, typographical or calculation errors identified before a booking is confirmed.
2.6 Where supplier pricing or availability changes before confirmation, we may revise the quotation accordingly.
2.7 A quotation is based on the information available to us at the time it is prepared. Changes to guest numbers, venue, access, event duration, styling requirements, scope or other circumstances may require the quotation to be revised.
3. BOOKING CONFIRMATION
3.1 A booking is confirmed when the requirements specified by Piece Of Cake Events have been completed, which may include acceptance of the quotation, placement of an online hire order, payment of the required booking retainer, deposit or hire amount, and written confirmation from Piece Of Cake Events where applicable.
3.2 Enquiries and quotations do not constitute confirmed bookings.
3.3 Until a booking is confirmed, we may accept another booking for the same date, products or services.
3.4 Payment of a booking retainer, deposit, invoice or online order constitutes acceptance of the applicable quotation, order details and these Terms.
4. BOOKING RETAINERS, DEPOSITS & PAYMENTS
4.1 A booking retainer or deposit may be required to secure an event date, service, supplier or hire inventory.
4.2 Booking retainers may be non-refundable to the extent permitted by law because they may represent reservation of the event date or inventory and administrative, planning or preparation work undertaken following confirmation.
4.3 Payment schedules will be specified in your quotation, invoice or online booking.
4.4 Unless otherwise stated, final payment for event services may be required no later than fourteen (14) days before the event.
4.5 Bookings made within fourteen (14) days of an event may require immediate payment in full.
4.6 Custom products, specially sourced items, third-party supplier costs and certain hire items may require earlier or full payment.
4.7 Failure to pay an amount by its due date may result in suspension of planning, ordering, delivery, installation or other services and may ultimately result in cancellation of the booking, subject to applicable law.
4.8 We are not required to deliver products, release hire equipment or commence an event installation while undisputed overdue amounts remain unpaid.
5. CHANGES TO THE BOOKING
5.1 Changes requested after confirmation are subject to availability and approval.
5.2 Changes may result in additional charges where they increase planning or coordination time, staffing, supplier costs, quantities, equipment, materials, delivery requirements, installation or pack-down time, transportation, event duration or the overall scope of work.
5.3 Significant changes may require a revised quotation.
5.4 Reductions in scope after products, suppliers, inventory or labour have already been committed do not necessarily result in a corresponding refund.
6. EVENT PLANNING, COORDINATION & CREATIVE DIRECTION
6.1 Event planning and coordination may include concept development, budgeting assistance, venue liaison, supplier sourcing, quotation management, scheduling, run sheets, logistics, creative direction and other agreed services.
6.2 The Client agrees to provide accurate and timely information reasonably required for us to perform our services.
6.3 Delays in approvals, decisions, payments or information supplied by the Client may affect our ability to meet agreed timelines.
6.4 Additional work outside the agreed scope may incur additional charges.
6.5 Where we provide creative direction, styling concepts or recommendations, reasonable creative discretion may be exercised in bringing the agreed concept to life.
6.6 Event concepts may evolve due to venue requirements, product availability, supplier availability, safety considerations or practical installation requirements.
7. THIRD-PARTY SUPPLIERS & EVENT PROCUREMENT
7.1 As part of our planning and coordination services, Piece Of Cake Events may recommend, source, obtain quotations from, coordinate, book or facilitate arrangements with third-party suppliers.
These may include venues, caterers, food trucks, coffee carts and mobile vendors, musicians, DJs, entertainers and performers, photographers and videographers, florists, security providers, event nannies and childcare providers, AV, sound and lighting providers, staging providers, furniture and equipment suppliers, marquee and infrastructure providers, transport providers, specialist event contractors and other suppliers reasonably required for an event.
7.2 The contractual arrangement with a third-party supplier will depend on the particular booking. A supplier may be engaged directly by the Client, invoice the Client directly, be engaged by Piece Of Cake Events as part of an agreed package, or otherwise be arranged as specified in the quotation or booking documentation.
7.3 Where the Client contracts directly with a supplier, that supplier’s own terms, payment requirements, cancellation conditions and policies apply.
7.4 Where we collect or facilitate payment relating to a supplier, non-recoverable supplier costs may remain payable if the booking is cancelled or changed.
7.5 We will exercise reasonable care when sourcing or recommending suppliers. However, independent third-party suppliers remain responsible for their own goods, services, conduct and legal obligations.
7.6 If a supplier becomes unavailable due to circumstances outside our reasonable control, we will use reasonable efforts to identify a suitable alternative where practicable.
7.7 Replacement suppliers may have different pricing, availability or conditions. Any material difference will be communicated where reasonably practicable.
8. CORPORATE, GOVERNMENT, SCHOOL & COMMUNITY EVENTS
8.1 Certain events may involve additional requirements including venue inductions, contractor registrations, SWMS or safety documentation, risk assessments, public liability requirements, permits, council requirements, loading-dock bookings, security procedures, working-with-children requirements where applicable, or other venue or regulatory requirements.
8.2 The Client must disclose known requirements sufficiently in advance.
8.3 Additional administrative, compliance, staffing or documentation requirements not included in the original scope may incur additional charges.
8.4 Where a permit, licence or approval is the Client’s or venue’s responsibility, the Client must ensure it is obtained before the relevant service is performed.
9. CANCELLATIONS, POSTPONEMENTS & REFUNDS
9.1 Cancellations, postponements, rescheduling, credits and refunds are governed by our Return, Refund & Cancellation Policy, which forms part of these Terms.
9.2 Cancellation or postponement requests should be made in writing as soon as reasonably possible.
9.3 Third-party supplier cancellation and postponement terms may also apply.
9.4 Amounts relating to services already performed, products already ordered or prepared, supplier commitments and other reasonable costs already incurred may remain payable, subject to applicable law.
9.5 Nothing in this section limits any rights available under Australian Consumer Law.
10. DELIVERY, INSTALLATION, PACK-DOWN & COLLECTION
10.1 Delivery, installation, collection and pack-down are included only where stated in the product listing, quotation, invoice, checkout or booking confirmation.
10.2 Hire items may be offered as Dry Hire, where the Client collects and returns the items by appointment, or as a delivery, delivery and collection, or Full Installation & Pack Down service.
Full Installation & Pack Down
10.3 Where Full Installation & Pack Down is selected or required for hire equipment, the standard installation and pack-down charge is 20% of the total hire-item value, subject to a minimum charge of $170, unless otherwise stated in the quotation, product listing, invoice or booking confirmation.
10.4 For the purpose of calculating this charge, the hire-item value is the standard hire value of the applicable equipment before promotional discounts and excludes delivery, collection, travel and other service fees.
10.5 The installation and pack-down charge does not include delivery, collection, travel, parking, tolls or applicable after-hours, Sunday or public holiday surcharges. These are calculated separately.
10.6 Additional labour or charges may apply where an installation involves unusual complexity, additional staff or crew, difficult or restricted access, stairs, extended carrying distances, venue restrictions, specialist equipment, extended waiting periods or requirements materially outside the standard scope.
Delivery & Collection
10.7 Delivery and collection charges may take into account distance, travel time, number of journeys required, vehicle requirements, parking, tolls, loading restrictions and other logistical requirements.
10.8 Hire delivery and collection may involve separate journeys to deliver equipment and subsequently retrieve it. Applicable travel and delivery/collection charges will be advised through checkout, quotation, invoice or booking confirmation.
Non-Hire Deliveries & Installations
10.9 Purchased and non-hire products may also be delivered, installed, styled or set up by Piece Of Cake Events where offered or agreed.
This may include balloon deliveries and installations, full-room balloon installations, school balloon installations, dinner-party styling, gifting, decorative installations and other products or services that do not involve the installation of hire equipment.
10.10 Standard service hours for these non-hire deliveries and installations are 9:00 am to 6:00 pm.
10.11 Where a non-hire delivery, installation, styling service or setup is required:
6:00 am to 9:00 am: $50 surcharge
6:00 pm to 9:00 pm: $50 surcharge
These charges are additional to the applicable delivery, installation, styling or labour charges.
10.12 Services required before 6:00 am or after 9:00 pm may attract the applicable after-hours charges under Section 12.
10.13 The Client must provide accurate venue, delivery, installation and access information.
10.14 Additional charges may apply where actual access or installation requirements materially differ from those disclosed before confirmation.
10.15 Where our staff or contractors are required to wait because the venue, Client or another supplier is not ready at the agreed time, reasonable waiting-time or additional labour charges may apply.
10.16 Delivery and installation times may be estimates and can be affected by traffic, weather, venue access and circumstances outside our reasonable control.
10.17 Clients must ensure hire items are accessible at the agreed collection or pack-down time.
11. VENUE ACCESS, BUMP-IN & BUMP-OUT
11.1 The Client must provide accurate bump-in, event and bump-out times and notify us of venue restrictions.
11.2 Unless expressly included in our scope, the Client is responsible for confirming that the venue permits the proposed installation and equipment.
11.3 The Client must disclose stairs, restricted lifts, loading zones, loading-dock procedures, long carrying distances, limited parking, security requirements, venue inductions, restricted installation times, ceiling or wall restrictions, power restrictions and other relevant access limitations.
11.4 Additional charges may apply where undisclosed conditions materially increase labour, transport or installation requirements.
11.5 We may refuse or modify an installation where conditions are unsafe or would breach venue requirements.
12. AFTER-HOURS, SUNDAY & PUBLIC HOLIDAY SERVICES
12.1 Unless a different surcharge is expressly specified for a particular product or service elsewhere in these Terms, the following after-hours surcharges may apply to event-hire delivery, installation, pack-down, collection and other on-site event services:
7:00 pm to 9:00 pm: $100
9:00 pm to 11:30 pm: $200
12:00 am to 6:00 am: $400
12.2 Non-hire deliveries and installations between 6:00 am and 9:00 am or between 6:00 pm and 9:00 pm are instead subject to the $50 surcharge specified in Section 10, unless otherwise quoted.
12.3 Sunday Surcharge: A surcharge of $100 may apply where delivery, installation, pack-down, collection or other on-site services are required on a Sunday.
12.4 Public Holiday Surcharge: A surcharge of $250 may apply where delivery, installation, pack-down, collection or other on-site services are required on a public holiday.
12.5 Where multiple timing or day-based surcharges could potentially apply, the applicable charge or charges will be identified through the quotation, invoice, checkout or booking confirmation.
12.6 Additional labour or waiting-time charges may apply where an installation, pack-down, collection or other service extends beyond the agreed service period because of Client, venue or third-party delays.
12.7 Where event or venue requirements change after confirmation and result in an after-hours, Sunday or public holiday attendance not included in the original booking, the applicable surcharge may be added to the booking.
13. DRY HIRE & CLIENT COLLECTION
13.1 Dry Hire collection and return are by appointment from the nominated Piece Of Cake Events collection location unless otherwise agreed.
13.2 The Client is responsible for providing a vehicle suitable for the safe transportation of all hire items.
13.3 Clients should inspect hire items at collection and raise any apparent concerns before leaving where reasonably practicable.
13.4 Responsibility for hire equipment passes to the Client when the equipment is collected and continues until it is safely returned to Piece Of Cake Events.
13.5 The Client is responsible for appropriate loading, transportation, storage, security and handling during the hire period.
13.6 Piece Of Cake Events may refuse to release an item where we reasonably consider the Client’s proposed transportation method unsuitable or unsafe.
14. HIRE PERIODS & RETURNS
14.1 The applicable hire period will be stated in the product description, quotation, invoice, online order or booking confirmation.
14.2 Depending on the booking, hire may include 24-hour, three-day, seven-day or another agreed period.
14.3 The hire period begins upon collection, delivery or installation, as applicable.
14.4 The hire period ends when the equipment is returned to or collected by Piece Of Cake Events.
14.5 Hire items must be returned or made available for collection at the agreed date and time.
14.6 Late returns may incur reasonable additional hire charges, particularly where the delay affects another booking, requires additional staff time or extends the agreed hire period.
14.7 The Client should notify Piece Of Cake Events as soon as reasonably possible if they believe a return or collection will be delayed.
15. OWNERSHIP & USE OF HIRE EQUIPMENT
15.1 All hire equipment remains the property of Piece Of Cake Events unless expressly sold to the Client.
15.2 Hire equipment must be used only for its intended purpose.
15.3 Unless authorised in writing, hire equipment must not be painted, drilled, stapled, cut, glued, permanently taped, modified or altered.
15.4 Hire equipment must not be sub-hired, sold, transferred or provided to another person for use outside the agreed booking.
15.5 Professionally installed structures, backdrops, displays and other styling elements should not be relocated, modified or dismantled without permission where doing so may create a safety or damage risk.
16. BALLOON INSTALLATIONS & PIECE OF CAKE EVENTS STRUCTURES
16.1 Balloons and certain decorative materials incorporated into a balloon installation may become the Client’s property where they are sold as part of the booking.
16.2 Unless expressly stated as being sold to the Client, all structures and reusable equipment used to support, construct or display a balloon installation remain the property of Piece Of Cake Events at all times.
